History of Prenuptial Agreements

Definition of Prenuptial Agreement

A Prenuptial Agreement ("prenup" for short) is a written contract created by two people before they are married. A prenup typically lists all of the property each person owns (as well as any debts) and specifies what each person's property rights will be after the marriage.
In some jurisdictions, a prenuptial agreement is known as an “antenuptial agreement,” or in today’s terminology, as a “premarital agreement.” The word “agreement” is sometimes substituted for “contract” as in “prenuptial contract.”
Who Should Make a Prenuptial Agreement?

US Citizens: Prenuptial agreements are valid in all 50 states. In fact, since 1983, at least 26 states have enacted a version of the Uniform Premarital Agreement Act, which encourages enforcement of prenups. Case law is sufficiently developed that a well-drafted prenuptial agreement, properly prepared by counsel for both parties, can withstand the toughest scrutiny.

UK Citizens: Prenuptial Agreements are not recognized by law in United Kingdom. However, some weight “may” be given by the court; it will nevertheless take the content of the agreement into account when reaching its decision. It is strongly recommended for British and UK Citizens to draft a prenuptial agreement for prior to marriage to Thai fiancé.

Benefits of Prenuptial Agreement

1. Protect your Separate Property

Frequently, disputes arise over how marital property should be allocated. Prenuptial agreements can be used to provide assurance that a couple's property will be disposed of according to their intentions. Through such an agreement, parties can designate ownership of property in the event of divorce, separation, or death of either spouse. The prenuptial agreement may provide for certain property to be transferred from one spouse to the other to create separate or joint property rights. These dispositions, and the contingencies on which they would occur, can be set forth in an organized and thoughtful manner in a properly drafted prenuptial agreement.

2. Protecting Business Assets

In cases where a business is owned by a small number of parties (e.g., a closely held corporation or a partnership), it is not uncommon for the owners to want to prevent a spouse from obtaining voting rights or claims against the business. In such cases, the owners can enter into an agreement that requires each, in the event that they marry, to execute a prenuptial agreement that provides for the prospective spouse to waive all rights to the owner-spouse's interest in the business in the event of divorce or death. The business associates may also wish to enter into a buy-sell agreement, where upon the death of a shareholder or partner, the remaining owners are required to purchase the decedent's interest in the business for a specified amount over a specified period.

3. Protection from other spouses debts

If one spouse incurs substantial debts before marriage, there may be a desire to protect the assets of the new spouse from the creditors of the debtor spouse. This can be accomplished in a prenuptial agreement by having the debtor spouse waive any claims to the new spouse's assets, except in the event of divorce or death.

4. Provide for Children

A prenuptial agreement can designate responsibility to provide support for children of a previous marriage, as well as children of the upcoming marriage. This may be especially important in instances where one spouse intends to give up a career as part of the marriage arrangement. The agreement can also cover issues concerning custody of all children.

5. Pass on Family Property

If one spouse has substantial interest in a family business, it is often the desire of that spouse, as well as the family members engaged in the business activity, to keep ownership within bloodlines. This could also be the case with family heirlooms and other assets of the family. It is not uncommon for parents and grandparents in wealthy families to be concerned about protecting family assets from the claims of an unintended heir, such as a decedent’s spouse. A prenuptial agreement can be written to provide that such assets are immune from claims by the new spouse.


Most states include a provision in their probate laws preventing one spouse from completely disinheriting the surviving spouse. These laws usually give the surviving spouse the right to elect against what was provided in the will and instead takes a set percentage of the deceased spouse's assets. Typically, the elective share is one-half or one-third of the estate Unified Probate Code Sec. 2-201, 8 U.L.A. 74 (1983).


6. Reduce Litigation Costs

Prenuptial agreements can eliminate litigation costs associated with contesting the will of a deceased spouse. They can be used to facilitate the divorce process and to provide assurance that the property will be distributed the couple's wishes. Individuals who have experienced a lengthy, messy divorce realize that a considerable amount of wealth can be lost during a legal battle, including legal fees and the fees charged by appraisers and expert witnesses.

Marriage does not last forever. It terminates with either death or divorce. Today, with the incidence of divorce on the rise and an increasing number of divorced persons remarrying, prenuptial agreements may become the rule, rather than the exception. Prenuptial agreements are becoming increasingly acceptable by jurisdictions whose courts are crowded with divorce cases and are looking for ways to reduce litigation.

Being born on 5th December 1927 and acceded to the throne as King Rama IX on 9th June 1946,
the King of Thailand is the world's longest-reigning monarch and the longest-serving Head of State.

From Sukhothai to Ayutthaya through Thonburi to Bangkok

The Thai monarchy has been in continuous existence since 1238 A.D., the founding date of the Kingdom of Sukhothai by King Sri Indraditya – the first King of a unified Thailand. In 1279, the King Ramkhamhaeng, called Pho Khun Ramkhamhaeng the Great (the father of the nation), came to the throne. The Kingdom of Sukhothai was eventually succeeded by the Kingdom of Ayutthaya, founded in 1351 by King Ramathibodhi I. For four centuries Thai Kings, especially the King Trailokanat, ruled Ayutthaya, presiding over some of the greatest period of cultural, economic and military growth in Thai History. All of this ended in 1767, when a Burmese Army invaded and sacked the city of Ayutthaya.

After the fall of Ayutthaya kingdom, there was a brief episode in the history of Siam associated first with the civil war, and then, the short-lived Thonburi Kingdom under the King Taksin. In 1782, a new Kingdom was established by King Buddha Yodfa Chulaloke or Rama I, when he moved the capital from Thonburi across the Chao Phraya river to Bangkok. Actually, at that time it was an Island on Chao Phraya river called Rattanakosin. Thus, has been launched a new distinct period in Thai history called Rattanakosin Era.

The King Rama I has founded the Chakri dynasty, which is currently ruling in Thailand. In 1868, the King Chulalongkorn or Rama V called The Great Beloved King ascended the throne as King of Siam. Being educated by Westerners, he embraced many of European and Western ideas in modernizing Siamese kingdom. King Chulalongkorn managed to save Siam from being colonized and was considered one of the greatest kings of Siam. In 1910, he was succeeded by his son the King Vajiravudh or Rama VI, who brought the monarchy into the 20th century. In 1925, he was succeeded by his brother the King Prajadhipok or Rama VII. The institution reached its current constitutional form in 1932, after a bloodless coup carried out by a group of foreign educated students called "the Promoters", which ended the absolute monarchy.

From 8 till 13 June 2006 Thailand celebrated the 60th anniversary of His Majesty the King's accession to the throne. The celebrations incorporated series of events marking Bhumibol's reign. Events included the royal barge procession on the Chao Phraya River, fireworks displays, art exhibitions, pardoning 25,000 prisoners, concerts and dance performances. People all over the country have been wearing yellow shirts with the royal emblem in celebration of this very special event. Kings and queens, monarchs and sultans, princes and princesses, royal ancestries, royalties and dignitaries from 25 countries around the world gathered in the Thailand capital Bangkok to mark King Bhumibol Adulyadej 60 years on the throne and pay their respects.

Well, we all are slaves to our habits.

Thai politico Government officials, to say the least, tend to turn a blind eye attitude to the emergence of Tough Ladies, being aware of the economic contributions the tourist industry brings about, and following the Golden Rule: "He, who has the gold, makes the rules."
A magnitude of Tough Ladies is quite pitiable for the Thai politicians, often called here Politico, themselves infamous for the playboy behavior. Unable to deal with socio-economic roots of this massive social illness, their rhetoric is blatantly regretful, especially whenever the issue gets out of (their) hands into a spotlight of a global media reaching an international attention.

A fact of the matter is that mainly in the northeastern provinces poor families with 10–12 or even more kids are strained to "sell" some of them in order to support, educate and feed the rest. Some even deem to believe that these children would have a better life away from the deprived family. Lots of abused girls upon found pregnant are kicked out of school. Most such girls are bumped into working in bars as there is nothing better for them to do. With the money earned, most girls support their needy upcountry family who's taking care of unparented children while Tough Ladies at work. Admittedly or not, many more sexy girls take on the same path simply because it is much more profitable. Cases where livelihood takes precedence over virtue.

So, what are prostitutes planning?

Usually, they have no plan, except to find a rich foreign guy willing to support them. They live day to day. They don't make much effort to think proactively. They just follow and react to others in their environment, passive.

If they have a plan, then it is to sit at home and watch TV all day, gossip with their friends, and go shopping.

If you expect them to cook special food for you or do other considerate things -- for them to put out the same level of effort for you that you put out for them -- then you're usually setting yourself up for disappointment. In fact, you will be lucky if they can even manage the maid and gain the respect of one for long.

That said, I must say that there are exceptions, as I know guys who have wives and girlfriends who are appreciative, diligent and more than earn their keep. (Sometimes I wonder if the guy deserves the lady!)

However, the good situations are far outweighed in sheer numbers by the negligent ladies.

Over time, a guy becomes more and more skeptical about ladies who express a willingness to develop a career alternative to prostitution. Is it just easy talk, "at the moment"? That is the issue to resolve.

For awhile, I gave them credit for having the courage to venture out into farangland in order to expand their horizons. However, more often than not, it's just to find someone to support their lazy, ultra laid back lifestyle, and take them away for some exciting and free (indeed, profitable for them) vacation adventures.

You can put in a lot of effort, time and money to help them, but when you need it in return, will they give you a significant amount of time and effort to help you?

Don't try to make them into something they are not. They are professional pleasers, and they will please your need to try to help them, but most of them won't help you back. When the time comes, after they've sucked you dry, they will just spit you out, often dramatically ... more often than not.

If misery loves company, the let it be known that I've known guys who have lost millions of baht, some their entire life savings, all hard earned and saved. Beyond people I've known, I've also heard of guys who have lost TENS of millions of baht. One guy married the lady and bought a life insurance policy, assigning her as the beneficiary. Her family hacked him to death (not very cleverly, either) in order to claim the money. Thus, he lost not just his money, but literally lost his life.

If you have invested a lot of money into a lady and have been ripped off, then be careful about trying to get any of it back, considering the possible dangers of this pursuit.

Be thankful for what you've got, and your own options in life.

Thai Girlfriends - [Ex-] Prostitutes

Prostitutes are the majority of the Thai women that individual western men know, and the foreigner areas of Thailand tend to have an amazingly high population density of them. Traveling into those parts of town is like traveling into a subculture.

The large number of farangs with Thai girlfriends and wives taken from freelance prostitution pickup places and outright go-go bars is mainly due to the fact that it's much quicker and easier to develop a full blown relationship with a prostitute and there are lots and lots of beautiful, lovely and outgoing farang-oriented prostitutes in the farang parts of the city. Years of observation have shown it's too easy for a farang to become involved with a Thai prostitute of one kind or another.

From my observations, most such relationships don't work out well in the end, for various reasons. Analyzing the successes and failures of such relationships turns up one most common and simple factor in determining the success and failure of relationships with [ex-]prostitutes -- how long the female was engaged in prostitution in any form before meeting her boyfriend. After that, the second most important factor is in regard to expectations, understanding each others' limits, and general cultural and relationship issues, as discussed in both of my longer discourses on "bar girl and freelancer girlfriends" and "mainstream Thai girlfriends", and accepting those differences rather than trying to change the other person very much.

Thailand is well known for prostitution, it's blown way out of proportion as regards foreign views of Thailand on average. Prostitution is common around in Thailand. In fact, according to international human rights reports, prostitution in Thailand. The reasons that Thailand is particularly well known for it are due to the somewhat different nature of prostitution in Thailand.

1. Many of the ladies in prostitution here are lovely in a "native" cultural way and don't fit into the usual mold of prostitutes in other countries -- it has a different manifestation here. This, combined with other Thai traits, often results in misunderstandings by foreigners. Indeed, many foreigners don't call this prostitution, and many Thai ladies also call this "working with guests" or "working nighttime" and would not use the Thai word for prostitution because that's impolite and demeaning. (But if money changes hands for daily service, then yes, it's prostitution, by my definition!)

2. The prostitution districts in Thailand are safe and laid back (with few exceptions), thereby attracting men who want a sex holiday without dangers (relative to similar places overseas).

3. The price is low, both for the ladies and accommodation & general expenses here, which attracts many holidayers who want more bang for their buck.

Farangs take on Thai prostitutes as girlfriends and wives far more commonly than they take on prostitutes in other countries.

Profile of a Typical Thai Prostitute

Approximately two-thirds of farang-oriented prostitutes probably have nearly all of the following in common:

* Born and grew up in Isaan - the poor northeast
* Have the standard 6 years of government-funded education (or less)
* Has worked on a family rice farm during the planting and harvesting periods
* Previously worked in difficult and low wage jobs (e.g, Eu.100/month, 60 hours/week), e.g., textile factory, helper of a street food vendor, etc., during non-planting/non-harvesting time
* Didn't go to entertainment places until entering prostitution
* Brought in by a trusted friend, eased into prostitution slowly but now easily goes with men
* Content with their current occupation, having lots of fun hanging out with their friends in a fairly stimulating environment with money
* Still doesn't drink alcohol or do drugs
* Brings money to their provincial home regularly
* Family doesn't know they work as a prostitute (until they bring a farang home)
* Lacks self-discipline when it comes to developing skills useful for other work
* Has very simple outlook on life -- likes to be with friends (they tend to be in groups in the bars), eat Isaan food, wake up late
* Have become skilled to some extent at "entertaining" foreign men

More than half have these additional traits:

* Offspring with a deadbeat Thai father (ex-boyfriend or ex-husband), which adds financial pressure
* Offspring being raised by parents in province, not Bangkok
* Significantly greater than average monetary pressures from home, e.g., for supporting siblings and parents

Typical day in the life of a Thai prostitute:

* Lives in an apartment building populated with other prostitutes
* Wakes up late
* Watches TV a few hours
* Eats a noodle pack if too lazy to go out
* Plays cards and gambles with their friends (the harder core ones tend to be gamblers)
* Eats some tasty, spicy Isaan food on the street or near the bar, with friends
* Takes a motorcycle taxi or regular taxi to their go-go or freelance bar for about 50-100 baht (rather than the 4 baht bus going the same way)
* Gets a customer... sometimes more than one per nite
* Takes a taxi home

Day after day after day ... except the times they go on holidays with farangs, and usually the farang does all the work in making all transport, hotel and other arrangements, with them in tow as companion and entertainer. They have a good time, and the farang has sex but often send them back home prematurely and opts off for other samples of the local flesh.

Some guys try to make a bar girl into a girlfriend. The ones who are "successful" tended to get the lady within the first month or so of her entering the scene. After that, it's usually too late.

There are gold diggers everywhere. You have to ask why a girl is attracted to a relationship with you, a foreigner, especially if she is quick to it. It is my experience that most Thai girls are after my money (and don't take any), but I am picky and patient. Your mileage may vary. A sizable percentage of non-prostitutes are attracted largely to the farang's money and material well being, and/or some Hollywood-based illusion they may have of life in a farang's country. They may simply look to a farang to take care of them, everything, whereby they'd "have it made in life". Matrimonial prostitution (though they don't see it that way)
The DOCTORTILAC has much more experienced In addition to my own experiences since 2000, and those of my friends and associates with mainstream Thai culture than with the foreigner-oriented, prostitution-common areas, though I'm quite experienced in both, with quite a large number of my own experiences of various sorts. However, compared to the vast majority of farangs who live in Thailand, I'm far more experienced with the mainstream Thai ladies and Thai gentle-men, and can educate and advise other farangs accordingly, providing a greater overall perspective.
The prostitutes are far more willing with sex, quickly, so you don't waste much time getting them there, they don't give you problems when you've had enough of them and pay them off (quite unlike a normal lady), and there are a variety of other lovely beauties out there for your next adventure. For what you pay per night, it's pretty cheap when compared to the real costs (both time and money) on an alternative, serious relationship, and you avoid the emotional pitfalls of something more serious. Even if you keep a prostitute for a few days or weeks and enter a grey area relationship, she'll usually be out of your way with her next distraction -- another farang man in her normal environment...

The besotted foreigner, usually white, who marries a Thai lady half his age in Thailand usually discovers his wife has a Thai husband.
DO NOT fall in love with the first Thai lady who comes over to you. Despite the warning, which appears in websites on Thai nightlife, that is what a guy – usually a white heterosexual male – visiting Thailand for the first time will do when he goes to Thailand,
“The guy does fall in love with her. He gets laid! He then has an affair with her lasting for a few weeks or maybe even longer.
“It might end happily, but as he hasn’t bothered to learn any of the language, culture or history of Thailand it mostly likely ends in disaster.”
The farang (Thai for Westerner) can’t help falling in love because he has “not seen anything like it”.
“He walks into pattaya street full of gorgeous women – with perfect body, long black hair, light brown skin and almond eyes – and they welcome him with that beautiful Thai smile and make him feel like a king,” he explains.
The relationship, however, ends in a disastrous marriage,
The farang (usually in his 50s, 60s and 70s) discovers his wife (usually half his age) actually has a Thai husband.
Or he spends half a million US dollars on a huge tract of land (which must be under her name – in Thailand, farangs are only allowed to buy condominiums) to build a marital home and she later kicks him out.
The classic horror story told over and over in Thailand as a tale of caution is the one where the Thai lady has a Thai boyfriend or mother hungry of money and they have a sinister plan to kill the farang husband for his money.
“This happens quite often in Pattaya. You read in the Pattaya Mail about a guy who falls off the balcony and the police call it a suicide. But the article mentions that the man has his hands tied behind his back and a black stocking over his head,” Barrett relates.
The marriage ends in disaster because these guys do not speak Thai, make any effort to learn Thai history and culture and the psychology of Isaan women (most pattaya lady are from Thailand’s north-east).
“For these women, the mother is number one and not the husband as she owes her mother her life. And she will do anything to provide for her mother,
Asked whether the farang who marries a pattaya lady faces the stigma of marrying a prostitute,» No, because they are nothing like a prostitute.
They are much like a girlfriend even if you pay her money.
“And she'll way (a respectful Thai greeting) you in the morning.”
“But the girls have told me: ‘What do they think when I work in a factory outside Bangkok hunched 12 hours a day over a machine putting little electronic parts together for a fraction of what I earn in a nightlife establishment'?” he says.
